1. Shipzilla USA Inc. is a listing service that links together customers with
transporters.
2. This is the exclusive service we render and we are
not a freight
company.
3. Shipzilla's fees are independent of any other fee that could be charged by a
Broker to the customer.
4. Listing fees are determined in each case according to the type of vehicles, boats,
RVs and heavy equipment to be transported and
distances between pick up and
delivery locations.
5. The customer authorizes Shipzilla USA Inc. to charge his/her credit card upon
selection of a transporter.
6. The listing process works as follows:
a) the customer requests a quote,
b) the
customer fills in all the required information,
c) quotes are submitted on our website
and by email,
d) the customer compares quotes and accepts the preferred
transporter,
e) the customer pays Shipzilla's deposit,
f) the customer provides pick
up and delivery addresses and names and telephone contact numbers at pick up
and delivery locations,
g) the transporter immediately contacts the customer to
schedule a pick up.
6. Shipzilla's fees are refundable if the transporter fails to pick up as instructed by
the customer. Shipzilla USA Inc. liability is limited only
to the amount of the listing
fee charged. In case of a transporter cancellation by the customer, fees are not
refundable.
7. Shipzilla USA Inc. does not vouch for the accuracy and truthfulness of any
information provided by the transporter regarding insurance
coverage. It is the
responsibiliy of the customer to verify such information.
8. Shipzilla USA Inc. is not responsible for any damages that may occur during
transport and all claims must be made to the carrier and
their insurance company.
9. Shipzilla USA Inc. is not responsible for any pick up or delivery dates and for
weather, traffic or mechanical breakdown delays. Shipzilla
USA Inc. is not
responsible for any storage fees or car rental fees.
10. All actions or proceedings arising in connection with this agreement shall be
tried and litigated exclusively in the State or Federal (if
permitted by law and a
party clects to file an action in Federal Court) courts located in Broward County,
Florida. This choice of venue
is intended by the parties to be mandatory and not
permissive in nature, and to preclude the possibility of litigation between the
parties with respect to, or arising out of this Agreement in any jurisdiction other than
specified in this section. Each party waives any
right it may have to assert the
doctrine of forum non convenience or similar doctrine or to object to venue with
respect to any
proceeding brought in accordance with this section. By action of this provision the parties agree to submit to the personal jurisdiction
of the aforementioned court.
